A. Cancellation Policy

Introduction

Consumers are entitled to a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that can be predominantly attributed neither to their commercial nor their self-employed professional activity:

Right of Withdrawal

You have the right to withdraw from this contract within 30 days without giving any reason.

The withdrawal period is 30 days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.

To exercise your right of withdrawal, you must inform us (GEMA Sanitär - und Heizungsgroßhandel GmbH, Anhaltinerring 17, 39439 Güsten, Germany, Tel.: 039262 8787 0, E-Mail: verkauf@gema-net.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form for this purpose, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send the communication concerning your exercise of the right of withdrawal before the withdrawal period expires.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse you all payments received from you, including delivery costs (except for the additional costs arising from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired.

We bear the costs of returning such goods that, due to their nature, can normally be returned to us by post. You bear the direct costs of returning such goods that, due to their nature, cannot normally be returned to us by post (freight goods), which are estimated at a maximum of approximately 100 euros for each such item.

You are only liable for any diminished value of the goods if this diminished value results from handling of the goods that was not necessary for the purpose of examining their condition, properties, and functionality.

Exclusion or premature expiry of the right of withdrawal

The right of withdrawal does not apply to consumers who, at the time of concluding the contract, do not belong to any member state of the European Union and whose sole place of residence and delivery address at the time of concluding the contract are located outside the European Union.

General notes

1) Please avoid damage and contamination of the goods. Please return the goods to us in the original packaging with all accessories and all packaging components. If necessary, use a protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging.
2) Please do not return the goods to us carriage unpaid.
3) Please note that the aforementioned items 1-2 are not a prerequisite for the effective exercise of the right of withdrawal.
